    Discussed

The council discussed a concept plan for Ault Farms in the work session; no vote was taken. Ault Farms concept plan

    Discussed

The plan proposes 2,995 residential units on 438 acres, 12 acres of commercial and 200 acres for technology uses. Concerns included density, incompatible land uses, lot frontages not meeting code and apartments on Business Park/Light Industry land. Council Member Love asked for an eastern connection to the Triumph development; applicant representative Pete Evans said it crosses land owned by a third party. Council Member Curtis said earlier concerns had not been addressed.

Ault Farms master development plan, rezone and general plan amendment (work session)

    Discussed

Planning Manager Pete Kane presented a request on about 750 acres east of Pony Express Parkway near 3000 North, zoned Agriculture, to be spread across a range of residential, commercial and open-space zones. The plan would shrink Pony Express Parkway from a 122-foot minor arterial to a 77-foot minor collector, which staff opposed; the applicant later said the exhibit was wrong. The Planning Commission voted 4-0 on Feb. 9 to recommend denial of the general plan amendment, rezone and master plans for Areas 1 to 3, and suggested the lower 208 acres of business park be submitted separately. Council Member Jared Gray said density exceeded the buildable land and estimated 1,100 to 1,400 units; Council Member Donna Burnham supported multifamily near business uses but not smaller lots in the utility corridor; Council Member Carolyn Love said the unit count was excessive; Council Member Colby Curtis agreed with the Planning Commission; Council Member Melissa Clark said density exceeded the general plan. Applicant representative Pete Evans asked to use the utility easement for a public trail and equestrian facilities. No action was taken.

Ault Farms general plan amendment and master development plan

    Continued · 5-0

Mumford presented a revised plan for about 752 acres east of Pony Express Parkway with four areas (A to D) and a waiver of the 200-acre master plan maximum. The Planning Commission had recommended denial 4-0 on the prior plan. Council Member Colby Curtis preferred remanding it and, with Council Member Melissa Clark, was concerned about the waiver and an HOA controlled by an outside entity; Gray and Curtis opposed granting density from tables. One resident, Tiffany Ulmer, spoke about a trail on city land and school impacts. The council remanded both the general plan amendment and the master plan.

Ault Farms master development plan and rezone

    Approved with conditions · 3-1

The roughly 752 acres east of Pony Express Parkway are split into Area A (about 131 acres), B (243), C (162) and D (214, the southern tech campus/light industry area reserved for a future plan). The Planning Commission recommended approval 4-1 on July 13. Staff cited gross density of 3.25 units an acre, with RC and MF1 at 28.7 percent of the land. Council Member Melissa Clark wanted the Planning Commission's four-area division; Curtis was concerned about vesting, HOA control and school siting; Gray objected to RC and MF1 zoning; Council Member Donna Burnham questioned dividing into several plans. The council approved with ten conditions, including R1 zoning for specified R2 units, no density transfers from school or church sites, unit count limits, excluding the southern 214 acres, a parks plan before the agreement, and phasing limits. Burnham declined Clark's request to add the four-area division. No one spoke at the hearing.

Mumford said the plan, amendment and rezone were approved July 20. Cook said the well is within 300 feet of the existing well and impact-fee reimbursable.

Planning Manager Robert Hobbs presented 234 lots on about 75 acres. Steve Mumford noted the south side of George Washington Drive exceeds the 800-foot block maximum without a connection. Applicant representative Bronson Tatton agreed to narrow some frontages. The council set a 60-foot minimum frontage so a 20-foot connection fits, and approved with two 20-foot mid-block trails (George Washington Drive to Declaration Park, and Declaration Park to Benjamin Franklin Drive), north-side frontages on Benjamin Franklin Drive of at least 60 feet, and the park plan excluded.

    Denied · 5-0

Council Member Carolyn Love wanted masonry at a minimum along Pony Express Parkway, Council Member Colby Curtis preferred a higher standard and regretted past exceptions, Council Member Jared Gray supported masonry on major roads, Council Member Donna Burnham was concerned about inconsistent appearance and Wright favored a citywide masonry requirement on major roads rather than plat-by-plat approvals. The council denied the plan.

Applicant representative Bronson Tatton said townhomes are now 22 and 25 feet wide, Old Airport Road land is being dedicated and open space will be improved with a regional trail. Council Member Melissa Clark preferred keeping lot sizes over reducing them for open space; Wood wanted a safe pedestrian route across Old Airport Road. No one spoke at the hearing.

Lennar townhome exteriors, Parkway Fields (work session)

    Discussed

Planner Steven Lehmitz said the council approved the plat and site plan June 6, 2023 on a 3-2 vote with a condition requiring two exterior siding materials covering at least 30% of all sides of each building. The Building Division's approval letter references only the approved elevations. Lennar has been approved for elevations that differ from the council-approved designs, most townhomes are built, and a Lennar representative asked to continue building the remaining units as they are. No decision was made.

Notice of default to Lennar Homes under the Ault Farms development agreement

    Approved · 5-0

Planner Steven Lehmitz said the council met with Lennar Jan. 21 about Parkway Fields townhomes not matching approved elevations and mechanical units not screened as required by city code. On April 16 building permits were approved for the incorrect elevations, the units remained unscreened, and the city attorney issued a notice of default under Section 8 of the agreement. A Lennar representative disagreed with the notice and asked to be held accountable for future compliance. The council adopted the resolution.
