Ault Farms master development plan, rezone and general plan amendment (work session)
Discussed
Planning Manager Pete Kane presented a request on about 750 acres east of Pony Express Parkway near 3000 North, zoned Agriculture, to be spread across a range of residential, commercial and open-space zones. The plan would shrink Pony Express Parkway from a 122-foot minor arterial to a 77-foot minor collector, which staff opposed; the applicant later said the exhibit was wrong. The Planning Commission voted 4-0 on Feb. 9 to recommend denial of the general plan amendment, rezone and master plans for Areas 1 to 3, and suggested the lower 208 acres of business park be submitted separately. Council Member Jared Gray said density exceeded the buildable land and estimated 1,100 to 1,400 units; Council Member Donna Burnham supported multifamily near business uses but not smaller lots in the utility corridor; Council Member Carolyn Love said the unit count was excessive; Council Member Colby Curtis agreed with the Planning Commission; Council Member Melissa Clark said density exceeded the general plan. Applicant representative Pete Evans asked to use the utility easement for a public trail and equestrian facilities. No action was taken.
- Acres: about 750
- Planning Commission: 4-0 recommend denial (Feb. 9, 2021)

Brylee North general plan amendment and rezone
Denied · 5-0
The request covered about 22 acres west of Eagle Mountain Boulevard, north of Brylee Farms: 10.63 acres from Commercial to Commercial Regional and 11.4 acres to MF2 (Neighborhood Residential Three). The Planning Commission voted 4-0 on Jan. 12 to recommend approval with a Desert Willow Drive collector condition. Curtis said the original 2018 agreement traded multifamily for commercial acreage and he opposed more multifamily; Gray would not approve additional multifamily; Clark said commercial benefits the city more; Burnham said the parcel was too narrow for regional commercial. Applicant Randy Smith said MF2 would improve commercial feasibility. No residents commented at the public hearing.
- Acres: about 22 (10.63 Regional Commercial, 11.4 MF2)
- Planning Commission: 4-0 recommend approval (Jan. 12, 2021)
Item 12.A · Zoning
Scarlet Ridge Estates: transportation plan amendment and rezone to RD2
Tabled · 4-1
The request for about 160 acres east of Lake Mountain Road asked for a rezone to RD2 and a revised 211-lot preliminary plat (37 one-acre lots; 174 lots of about half to 0.71 acre; average about 0.6 acre) with a 2.5-acre park. Gray preferred a December 2019 layout with 139 lots; Curtis wanted a 50/50 split of RD1 and RD2; Love said she would likely reach consensus if the median lot were closer to an acre; Burnham said the variety and added one-acre lots were appropriate; Clark suggested tabling. Applicant Ryan Kent preferred tabling to denial. No residents commented at the public hearing. Burnham voted no.
- Acres: about 160
- Planning Commission: 4-0 recommend approval with conditions (Jan. 12, 2021)

Item 13.A · Development
Hidden Hollow Phase C density vesting
Tabled · 5-0
The applicant claimed vested density of 360 units and proposed 134 (48 single-family lots and 86 townhomes), about 60 percent fewer. The Planning Commission voted 3-1 on Feb. 9 to recommend approval with conditions: part of the density contingent on the sale of 1.5 acres of city land at fair market value, compliance with current code for the site plan and plat, and no blasting in Phase C. Curtis worried vesting could bind the city to the land sale; City Attorney Jeremy Cook said the sale would be considered with the plat. Applicant Ryan Bybee said the applicant would pay for a redesign.
