  1. Item 14.A-14.B · Development

Parkway Fields master development plan and agreement amendments

    Approved · 5-0

Planning Manager Robert Hobbs presented six changes, including townhome revisions, phasing, rezoning a small area from RC to MF1 for about four more townhomes, and access changes. Applicant representative Bronson Tatton said townhomes are now 22 and 25 feet wide, Old Airport Road land is being dedicated and open space will be improved with a regional trail. Council Member Melissa Clark preferred keeping lot sizes over reducing them for open space; Wood wanted a safe pedestrian route across Old Airport Road. No one spoke at the hearing.

  2. Item 15.A · City code

    Residential development standards, EMMC 17.25.040

    Approved · 5-0

City Attorney Marcus Draper explained the change, which requires amended plat portions to meet the zone's average lot size. It followed a proposed lot split that would have taken one parcel below the average. No one spoke at the hearing.

Moved by Council Member Rich Wood, seconded by Council Member Melissa Clark. Vote: 5-0

  3. Item 15.B · City code

    Title 15 construction standards

    Approved · 5-0

City Engineer Chris Trusty reviewed changes, including truck route approval requirements and updated references. In the work session staff said the city's insurer does not cover sewer laterals without a routine inspection program, so shifting lateral ownership could raise premiums, and that Section 15.30 was left out of the packet and cannot be approved until noticed. No one spoke at the hearing.

Moved by Council Member Rich Wood, seconded by Council Member Brett Wright. Vote: 5-0

  4. Item 15.C · City code

Fencing standards, EMMC 17.10.030 and 17.60.110-.130

    Approved with conditions · 5-0

The ordinance covers allowable materials, maintenance, privacy screens, electric fencing, berms or hedges as functional equivalents, chain link limited to school and industrial uses and abatement of unlawful fences. Council members wanted clearer rules on which roads need walls rather than fences and discussed concrete fencing for minor collectors. The council approved with four conditions: rewording the berm and hedge and abatement language, adding a split-rail definition and picture, and directing staff to return with commercial buffering and elevation changes. No one spoke at the hearing.

Moved by Council Member Rich Wood, seconded by Council Member Donna Burnham. Vote: 5-0

  5. Item 15.D · City code

Lot line adjustments, EMMC 17.10.030 and 16.50.020-.040

    Tabled

The ordinance responds to a 2023 state law allowing lot line adjustments by survey. Wood raised concerns about buffering, zoning conflicts, animal rights and effects on existing subdivisions. The council tabled it and told the city attorney to add a statement that lot line adjustments do not change zoning. The minutes record the vote as 4-1 but the scan does not show who voted no. No one spoke at the hearing.

Moved by Council Member Donna Burnham, seconded by Council Member Brett Wright

  6. Item 15.E · City code

    Liquor license rules, Chapter 5.15

  7. Item 15.F · City code

Lot size mixture in residential neighborhoods, EMMC 17.60.155 and 17.25.040

    Tabled · 5-0

Staff proposed limiting Neighborhood Residential One areas to no more than one-third R3 lots and no more than half of the rest R2. Wright supported it; Clark worried it was too prescriptive and could hurt affordability; Wood wanted more work to avoid unintended penalties; Gray asked for language saying developers are not guaranteed one-third R3 lots. The hearing was opened and continued to March 6, and the item was tabled for staff to meet with council members.

  8. Item 16 · City code

    Approved · 5-0

Wood's amended motion provides that the mayor or staff create no new policies, codes or ordinances without majority council consent in an open meeting, that the mayor recommends liaison assignments for council discussion and majority vote, and that no single member may decide for the body or imply authority to represent it without council approval. Draper raised possible First Amendment prior-restraint concerns and said he would research them. Burnham said her earlier requests, including an intent statement, were not addressed.
