Lakeland Industrial Park

Industrial park around 1700 South developed by Phelon Lakeland LLC. In January 2026 the city amended a reimbursement agreement to repay the developer up to $991,538 for system improvements. Dunn Construction's concrete crushing yard at 510 E. 1700 South is in the subdivision (Mr. Phelon held its land disturbance permit); after appeals on Sept. 23 and Oct. 28, 2025 the council ruled crushing a permitted use with conditions. Phelon Lakeland, American Eagle Ready Mix and MMD Property Management were co-defendants with the city in a suit by business park owner Mike Roderick that was dismissed in 2023. Phelon family businesses told the council in February 2026 that the zoning rewrite threatened them and that their facility supplies topsoil for city parks and the cemetery.

Dunn Construction business license appeal (concrete crushing)

    Tabled · 5-0

Legal counsel Heather Schriever explained the quasi-judicial standard. Attorney David Lambert (who disclosed connections to Councilmember Carroll and Councilmember Taylor's son), with Mike Dunn, Paul Washburn and Leslie Slaugh, argued concrete crushing is permitted 'processing of materials' in the I-1 zone, citing an RMEC environmental study and the 2023 Roderick v. American Fork City ruling (Fourth District Court, dismissed April 20, 2023) that upheld a ready-mix plant there; Dunn removed 240,000-250,000 tons of concrete from the Geneva Steel site. Staff said the use was not established before the 2019 annexation and no site plan covers it. Members debated the lack of measurable noise and dust standards; tabled.

Dunn Construction business license appeal (concrete crushing), 510 E. 1700 South

    Approved with conditions · 5-0

Tabled from Sept. 23. Attorneys David Lambert and Paul Washburn said an amended site plan shows storage, a weigh station and the crusher in the Lakeland Industrial Park, where Mr. Phelon held the land disturbance permit; neighbors include American Eagle Ready Mix. Staff said a new site plan is needed. Councilmember John described a dust plume during a recent windstorm. Findings: crushing and recycling clean concrete is 'processing of materials' permitted in the I-1 zone; the claimed pre-2019-annexation nonconforming use was not proven; no license until a site plan is approved. Conditions: 8-foot concrete wall around operations, piles no higher than 45 feet, DEQ dust standards, concrete only, operations 7 a.m.-5 p.m., and evidence of no pending DEQ, MS4 or state actions.
