High Pointe apartments (Lake City Row Phase 2)

Bach Homes apartments and townhomes (High Pointe, northwest part of Phase 2; Bach also controls the northeast part, Summit) in the Lake City Row planned community created by the 2019 Vest annexation, north of 620 South. The annexation agreement requires 100 square feet of commercial space per home across 1,058 entitled units, with commercial built ahead of residential phases; the DRC denied the plat in August 2025 for lacking the commercial element. After a Sept. 30, 2025 hearing, the council on Nov. 11, 2025 reversed the denial 3-2 (Holley and Hunter opposed), saying the decision sets no precedent for other phases. Written findings adopted Dec. 9, 2025.

Bach Homes appeal of DRC denial, High Pointe preliminary plat (Lake City Row Phase 2)

    Tabled · 5-0

Development Services Director Patrick O'Brien said the area came in through the Vest annexation (2019 annexation agreement, 2021 rezoning and development agreement); 1,058 units are entitled; there is no code definition of mixed use, so staff used Urban Land Institute and master developer Buck Swaney's description of a town center with ground-floor retail. Light industrial or flex space does not count toward the commercial ratio. Bach counsel Amy Walker (Miller Harrison) and Stewart Harman said state law requires ambiguity to favor the applicant and the 100-square-foot-per-unit ratio applies to the whole project, citing the Woodbury (Pando, about 98,000 sq ft) and H3 Plastics (about 60,000 sq ft) buildings, and benchmarks tying commercial construction to residential build-out. Harman noted Phase 3 (Arza, Soul Haven, Walton Townhomes, nearly 1,000 units) and Elevate at 620 (338 units, Bach) have no commercial; High Pointe is the northwest part of Phase 2 and Bach also controls the northeast part, Summit. Applying the ratio per property would require nearly 60,000 sq ft of commercial for High Pointe and Summit.

    • Entitled units: 1,058
    • Ratio: 100 sq ft commercial per unit
    • Elevate at 620: 338 units, no commercial

Bach Homes appeal of DRC denial, High Pointe apartments (Lake City Row Phase 2)

    Approved · 3-2

Sitting as appeal authority limited to whether the project met the commercial element requirement, the council reversed the DRC's denial. Holley said Lake City Row became apartments and asphalt with little open space and no commercial, calling the developer's equal-protection framing disingenuous; Carroll said she felt forced and betrayed by how the development agreement turned out; Mayor Frost said what was promised and what exists are 'two different things.' Bach Homes counsel Stewart Harman said earlier phases were built without commercial and the applicant was treated differently. The motion limited the decision to Phase 2 with no precedent for other phases. Written findings adopted Dec. 9.

High Pointe Apartments site plan, 620 S. 740 East (3.46 acres)

    Approved with conditions · 6-0

Commercial site plan for about 160 rental units: a building with structured podium parking and four residential stories above, plus townhomes fronting the south and east streets, in the PC Planned Community zone under the Lake City Row Development Agreement, which allows high-density mixed-use housing and requires 1.8 parking stalls per unit. Staff recommended approval with conditions including meeting minimum tree counts and correcting plan measurements. Cedar Jordan of Bach Homes said all units will be rentals, there will be no clubhouse but a gym, common areas, green space and a dog park, and the developer will build 740 East. Commissioner Rod Martin cited a local vacancy rate of about 2.9%.
