Council rules concrete crushing allowed in industrial zone, sets conditions for Dunn Construction

October 28, 2025, 7:00 p.m. · American Fork City Hall, 31 N. Church St.

The council conditionally overruled the city administrator's denial of a business license for Dunn Construction's concrete crushing and recycling at 510 E. 1700 South, finding it a permitted 'processing of materials' use in the I-1 zone, but requiring a new site plan, an 8-foot concrete wall, piles no higher than 45 feet, dust control, 7 a.m.-5 p.m. hours and proof of no pending DEQ actions. It also approved a UDOT statewide utility license and met in closed session on a property purchase after a property owner's representative asked for fair compensation for 2 acres needed for 700 North.

    Approved with conditions · 5-0 · 510 E. 1700 South

Tabled from Sept. 23. Attorneys David Lambert and Paul Washburn said an amended site plan shows storage, a weigh station and the crusher in the Lakeland Industrial Park, where Mr. Phelon held the land disturbance permit; neighbors include American Eagle Ready Mix. Staff said a new site plan is needed. Councilmember John described a dust plume during a recent windstorm. Findings: crushing and recycling clean concrete is 'processing of materials' permitted in the I-1 zone; the claimed pre-2019-annexation nonconforming use was not proven; no license until a site plan is approved. Conditions: 8-foot concrete wall around operations, piles no higher than 45 feet, DEQ dust standards, concrete only, operations 7 a.m.-5 p.m., and evidence of no pending DEQ, MS4 or state actions.
