Lake City Row memorandum of understanding (tabled)

    Tabled · 5-0

MOU with master developer MDP Land (partner Buck Swaney) would allow 1.8 parking spaces for studio and one-bedroom units, shared parking with future commercial buildings, limits on units until more water is available, and standard reimbursement for water lines. Taylor and Christiansen opposed reducing parking; Barnes worried about precedent and enforcement; Shelton wanted a work session. Tabled to a work session no later than May 5.

Lake City Row memorandum of understanding

    Discussed

Legal counsel Cherylyn Egner said the MOU clarifies that the code's parking table governs the mixed-use project (about 1.8 spaces per unit acceptable to staff), with shared parking easements recorded for each commercial site. Developer Buck Swaney said the project will have 1.5 million square feet of commercial space next to Utah Valley Business Park, cited a 2019 Orem parking study, and said residential construction is tied to 25% of commercial space being approved. Taylor said similar projects south of State Street have overflowing street parking.

Amended Lake City Row concept plan, about 860 E. 620 South

    Approved with conditions · 4-1

Adopted Ordinance 2021-05-23 amending the Lake City Row planned community concept plan to change a Phase 1 office area to commercial allowing one- and two-story flex office-warehouse, effective only once a development agreement is signed. The Planning Commission recommended denial on a split vote over shared parking. Buck Swaney of MDP Land said residential entitlement drops from about 2,000 to 1,700 units, cutting required parking from 4,559 to 3,841 stalls and the shared-parking deficit to 118. The site is about 6 acres, half owned by Millennial development (PC zone) and half by Woodbury (PI zone). Mayor Frost and Councilmember Barnes objected that the presentation was not in the packet or seen by the Planning Commission; Barnes voted no, saying it should go back to the commission.

    Approved · 5-0

Development agreement with the Lake City Row master developer (Arvil Swaney) and North Valley parcel owners implementing the concept plan amendment approved May 25, 2021. The adjusted plan cuts west-side residential units from 2,026 to about 1,700 and requires shared parking at least as shown on the concept plan; adjacent owners, including the Kurt V. Councilmember Carroll asked about signatories; Legal Counsel Cherylyn Egner said she was comfortable with the agreement.
