O'Reilly Auto Parts site plan (work session)

    Discussed

Senior Planner Tayler Jensen presented the plan for the lot next to Dollar Tree that backs onto Oak Hollow homes. The Planning Commission voted 3-2 on March 9 to recommend approval with five conditions. Parking was 28 stalls against 25 to 37 required. Love, Curtis and Clark wanted parking moved away from the homes and permanent screening; Gray said the applicant should propose the fix. Mayor Tom Westmoreland directed staff to work with the applicant on screening. A resident, Diana Anderson, asked the council to enforce the six-foot wall requirement and raised drainage concerns.

    Tabled · 4-0

Applicant representative Ryan Forsythe proposed options to screen headlights from Oak Hollow homes, including vinyl extensions to the wall, landscaping or slatted chain link. City Attorney Jeremy Cook said the code puts screening responsibility on the commercial developer. Resident Diana Anderson asked for a taller wall or thick evergreens. Gray and Council Member Carolyn Love suggested withholding the certificate of occupancy until screening is resolved; Council Member Melissa Clark was not comfortable approving without an adequate solution; Council Member Donna Burnham would approve once screening is adequate. The council tabled it to the next meeting.

Moved by Council Member Donna Burnham, seconded by Council Member Jared Gray. Vote: 4-0

Applicant Ryan Forsyth proposed vinyl wall extensions, then about 25 six-foot arborvitae along roughly 200 feet and removing about 8,000 cubic yards of dirt; Dollar Tree has a June 1 deadline with a $1,000-a-day penalty. Residents Brian Alexander and Tyler Anderson opposed vinyl; Cameron Moon accepted mature staggered trees with maintenance commitments; Diana Anderson preferred a taller wall or evergreens with replacement assurance. Gray said landscaping was inadequate and a six-foot masonry wall was required; Burnham supported a 3.5-foot fence with trees. Four motions failed: Burnham's first two (no second), Gray's to table (no second), and Love's with a screening test (2-3, with Curtis, Clark and Gray opposed). After reconsideration, Love's motion with five conditions (lighting, dumpster, bicycle parking, truck loading layout, and a 3.5-foot hedge plus staggered six-foot trees) passed 4-1, Gray opposed.
