Pioneer Heights final subdivision, 45 lots, 1452 W. 900 North

    Approved · 4-1

Developer Danny Gutierrez said the water concerns were addressed and engineers and the water department approved his plan. A neighbor asked about irrigation water, and a neighboring landowner was concerned drainage and groundwater would affect a detention pond next to his land. Council Member Koivisto wanted that resolved before moving; Council Member Chris Condie did not want to add requirements; City Engineer Lorin Powell said staff could investigate after approval. A first motion by Koivisto, adding that staff work with the developer and neighbors on water drainage from the detention basin, failed 2-3 (Albrecht, Condie and Hancock opposed). Condie's motion without that addition then passed 4-1.

    Approved · 5-0

Developer Danny Gutierrez said the stub roads to the east and west, the water easement recording and the groundwater concerns raised Dec. 8 had been worked out, with irrigation and tail water to be fully resolved before final approval. A neighbor said irrigation water could still reach land owned by the developer; another neighbor said the stub-road concerns were resolved to his knowledge. The council took the item off the table and granted preliminary approval.

    Tabled · 5-0

Developer Danny Gutierrez asked for a 95-foot-frontage exception or a flag lot so he could shift a stub road to give a neighboring landowner access. Mayor Johnson preferred compliant lots and a connection for neighbors' future development rather than a development agreement. Council Member Condie said the developer was already better off because of an earlier zone change and was uncomfortable landlocking a neighbor. Neighbors raised stub-road access, groundwater, irrigation tail water and an incorrectly recorded water easement, which Mr. Struthers said the city would correct. Council Member Koivisto asked for more thorough percolation testing in a drought year. The council tabled the plan so the developer could work out the stub roads with neighbors on both sides, address water issues, and fix the easement.
