Planning commission approves Vivian Estates 5B and four flag lots, denies glass exception for city water building
August 13, 2026, 7:00 p.m. · Lehi City Council Chambers, 131 N. 100 E.
After tabling it in July, the Lehi Planning Commission on Aug. 13 approved JDH Development's 10-lot Vivian Estates Phase 5B along Dry Creek, according to the city's project page. Commissioners also approved flag lots for Mike Greene, Nathan McBride and two Temple View Villas lots, along with an 11-unit condo plat for the Belmont Flex Suites, but denied a glass-requirement exception for the city's own Water Department storage building. They recommended approval of the Nancy Walker development agreement for heavy commercial use at 915 W. State Street, a zone fix for Jay Peterson's land and two code changes, and continued Perry Commercial's request to turn 5 acres near Timpanogos Highway into highway commercial to Aug. 27.

Item 3.9 · Development
Nancy Walker development agreement, 915 W. State Street
Recommended for approval
After the City Council tabled the Walker zone change from R-1-8 to Heavy Commercial in July, the city drafted a development agreement for the 2.581-acre property. It would allow only listed heavy commercial uses, limit vehicle access to State Street, require landscape buffering under Chapter 12 with an optional berm along Trinnaman Lane if neighbors agree, and require a final site plan within two years. Engage Lehi reports a positive recommendation, and the item went to the council Sept. 8.
- Applicant: Lehi City and the Estate of Nancy Walker (Deborah Walker, personal representative)
- Acres: 2.581
- Current zone: R-1-8; tied to proposed C-H zone change
- Access limited to State Street
- Optional landscape berm on Trinnaman Lane side
- Site plan required within 2 years
Item 3.10 · Zoning
Jay Peterson zone change, 0.406 acre at 3455 N. Center Pointe Drive
Recommended for approval
The city asked to rezone Jay Peterson's privately owned 0.406 acre from Public Facility to Transitional Holding (TH-5). Staff said the land was mistakenly zoned PF with the publicly owned Dry Creek Reservoir land when it was annexed in 2018. Its General Plan designation remains Commercial, and the owner must dedicate water rights when seeking a future rezone. The council packet says the commission gave a positive recommendation.
- Applicant: Lehi City (owner Jay Peterson)
- Acres: 0.406
- PF → TH-5
- General Plan: Commercial
- Annexed 2018 with Dry Creek Lake Annexation
Item 3.11 · Development
Water Department storage building glass exception, 300 West
Denied
The city's Water Department storage building, designed by Galloway and Company, does not meet the General Nonresidential Design District requirement for 20 percent glass. Designers said they added as much glass as a storage use allows and placed some above the first floor because the building sits below the sidewalk and roadway. Engage Lehi reports the Planning Commission denied the exception.
- Applicant: Lehi City (designer Galloway and Company)
- Requirement: 20% glass
- Address: 2548 N. 300 West on agenda; 2538 N. 300 West on Engage Lehi
Item 3.12 · City code
Residential renewable energy limits (Chapter 19)
Recommended for approval
The city proposed raising the maximum allowed kW for residential renewable energy systems. Following DRC comments, it would also drop references to heating and fluid heat systems and add an electrical energy storage section requiring compliance with International Fire Code Section 1207. The draft ordinance says the commission forwarded a positive recommendation, and the council took it up Sept. 8.
- Applicant: Lehi City
Item 3.13 · City code
Parking for therapy-focused preschools and daycares (Table 37.080)
Recommended for approval
The city proposed a new off-street parking requirement for preschools and daycares offering specialized therapy, which have higher staff-to-student ratios. The draft ordinance says the commission forwarded a positive recommendation. The Lehi Free Press reported the council later adopted it unanimously.
