JLG rezone to transit-oriented development near 200 South and Millpond Road

Request to rezone about 24.4 acres from RA-1, RA-5 and R1-20000 to TOD. The state property rights ombudsman said the city could not require a 100-foot right-of-way dedication at rezoning. Staff said the site cannot be gravity-sewered and lacks a second water feed; the council unanimously denied it April 22, 2025, finding insufficient infrastructure and enough existing TOD land.

JLG zone change to TOD, about 200 South Millpond Road

    Denied · 4-0

About 24.4 acres from RA-1, RA-5 and R1-20000 to TOD (2-20 units/acre by lot type). The state property rights ombudsman said the city could not require a 100-foot right-of-way dedication at rezoning. Public Works Director Sam Kelly said the site cannot be gravity-sewered (southern route blocked; Central Utah water main and TSSD lines on 200 South are barriers) and lacks a second water feed. Andy Flamm, for the Green family owners, asked to table. Hunter cited residents' objections and the area moratorium; Carroll cited south-side residents' frustration over 200 South and sewer; John said code bars pump stations in right-of-way. Denied on findings of insufficient infrastructure and adequate existing TOD land.
