Legal update on 'adjacent' and 'contiguous' in the PUD code
Discussed
City Attorney Ryan Wood distributed a memo on how the terms apply to Ivory Homes' Parkview Cottages application. He said 'contiguous' matches the state code definition but 'adjacent' is used inconsistently in city code. He said the more specific Chapter 39 definition fits how the PUD section has been applied in every other PUD, and recommended the city enter into a development agreement with the applicant to clarify application of the code. Community Development Director Kim Struthers said staff will amend the code definitions for clarity.

Ivory Development, represented by Brad Mackey, sought preliminary approval for 66 homes in a planned unit development. Koivisto said a PUD is restrictive and argued the open space is not contiguous as the code requires and that lot 101 does not conform; community development director Kim Struthers said contiguous can mean near or next to and the 15% open space requirement is met by a diagonal strip. Condie noted that enforcing the setbacks as residents read them would mean converting some homes to condos or townhomes. Residents asked for more parking, safer tree placement near entrances, a transition to larger lots to the south and strict setbacks, and one asked that the item be tabled until terms are defined. Koivisto's motion to table failed 1-4. Condie's motion approved the plan, with a smaller footprint on lot 101, changed tree varieties moved from intersections, 5 to 9 parking stalls added in parcel F near lot 141, and a legal report on the definitions of contiguous and adjacent. Southwick said he voted yes because Ivory followed staff's interpretation but agreed the definitions need review.
