Lehi council approves a string of annexations and subdivisions; legal memo urges development agreement for Parkview Cottages

January 28, 2020, 5:30 p.m. · Lehi City Administration Building, 153 North 100 East

The Lehi City Council approved the Forrest, Taylor Meadows and Refractory annexation steps, several final subdivisions and a boundary adjustment with Saratoga Springs, mostly unanimously. Agenda, item by item

  1. Item 2.2 · City code

Legal update on 'adjacent' and 'contiguous' in the PUD code

    Discussed

City Attorney Ryan Wood distributed a memo on how the terms apply to Ivory Homes' Parkview Cottages application. He said 'contiguous' matches the state code definition but 'adjacent' is used inconsistently in city code. He said the more specific Chapter 39 definition fits how the PUD section has been applied in every other PUD, and recommended the city enter into a development agreement with the applicant to clarify application of the code. Community Development Director Kim Struthers said staff will amend the code definitions for clarity.

Darwin Rehart raised concerns about the definitions of contiguous and adjacent. Jordan Fossen asked that accessory dwelling units be allowed in all areas of the city, including Planned Community zones. Wesley Davy objected that the agenda lists an 'opening comment' that is in practice a prayer and suggested including people of other faiths.
