Concept plan for four townhomes at 58 South 300 West

A concept plan would add four two-story attached rental townhomes to a 0.46-acre Mixed Use lot while keeping the existing home, for five dwellings in all. Staff say an all-rental layout does not meet recent Mixed Use code, which requires at least 30 percent of housing to be designed and platted so it can be individually owned, a design requirement rather than a sales requirement, and half of the floor area to be non-residential, unless the code is amended or a development agreement is reached. The Planning Commission reviewed the plan Oct. 8, but the packet page meant to hold its minutes and motion is empty, so its action has not been seen. The City Council is scheduled to act Oct. 27, and a concept plan does not vest.

Concept plan for four townhomes at 58 South 300 West

    Pending

The council is asked to approve a concept plan that would add four two-story attached units on 0.46 acre while keeping the existing home, for five dwellings in all, or just under 11 units per acre. Each townhome would have three bedrooms, one and a half bathrooms and one covered parking space. All four would be rentals under single ownership. The staff report says the site is zoned Mixed Use and downtown density is available, but recent code changes require at least 30 percent of housing to be designed and platted so it can be individually owned and half of the interior floor area to be non-residential. Staff say an all-residential layout would not meet code without a code amendment or a development agreement. The Development Review Committee also noted power, storm water and fire-truck turnaround requirements. The Planning Commission reviewed the plan Oct. 8; the packet page meant to carry the commission's minutes and motion is empty, so the commission's action has not been seen. A concept plan does not vest.

Tapley Project concept, four townhomes at 58 S. 300 West

    Recommended for denial

Tapley Mitchell (J Tapley Ronald Mitchell) proposed four three-bedroom, 1.5-bath rental townhomes, each with one covered parking space, behind the existing home in the downtown Mixed Use zone, keeping the existing structures. Recent code changes require 30 percent of housing in such projects to be platted for individual ownership and 50 percent of finished floor area to be non-residential, so the all-residential rental plan does not meet code without a code change or development agreement. Engage Lehi reports a negative recommendation, with the commission recommending the council consider a development agreement. Council action set for Oct. 27.

    • Units: 4 rental townhomes (3 bed, 1.5 bath)
