All Seasons Assisted Living general plan amendment, 1.52 acres (Ordinance 58-2022)

    Denied · 5-0

Applicant Jeffery Merchant said the company's goal is to help residents age in the community they grew up in, in small facilities rather than industrial or commercial areas. Planning Director Kim Struthers said the facility is a legal non-conforming use, so expansion would need a zone change; the council could approve the amendment, approve it with a development agreement locking in the use, deny it but use a development agreement limiting size and beds, or deny. Nine residents spoke against it: Doug Bark, Lane Adamson and Tyler Bateman said they believed the applicant's aim was to sell the property; Diedre Clark said other options exist; Owen Mecham said it would harm nearby homes and not fit the area; Kim Gardner and Kristina Brinkerhoff raised traffic near the school and safety; Raelynn Bateman said it would affect her rights; Nick Bendor said it is not the city's job to ensure the applicant's business succeeds. Council members voiced concerns, including about approving a development agreement without a solid plan. The council denied it with findings of negative effect on the area's character, lack of community benefit and nonconformance with the general plan, and suggested the applicant work with the city on the encroached parcel and frontage within current zoning.

Family Haven development agreement for uses other than elder care (pre-council)

    Discussed

Struthers asked whether the council would consider a development agreement for the Family Haven building that allows additional but similar uses and limits expansion of the building. Direction was given to the Planning Department to draft an agreement for council consideration. This is the property of the All Seasons Assisted Living amendment the council denied on October 11.
