Agenda, item by item

  1. Item 2.1 · General plan

Perry Companies concept: move 600 units from West Canyon to the Perry planning district

Discussed · West Canyon to near SR-92

Matt Swain of Perry Companies proposed relocating 600 residential units from West Canyon to lower land near SR-92, mixed with commercial, which he said would reduce canyon development and traffic and could leave the canyon as open space. Council members raised traffic concerns and asked for traffic studies, utility capacity analysis and a look at the long-term effects.

  2. Item 2.2 · Development

Gardner Group concept: add density to the Lehi Block development agreement

    Discussed

Gardner Group partners asked about amending the Lehi Block agreement, now approved for 250 homes and 5,000 square feet of retail, to add 350 homes and expand retail to 25,000 square feet, saying 250 to 350 more units are needed for viability. Council members worried about transportation and sewer capacity and noted developers have often delivered homes but little retail. The site sits between two future transit stations. No decision was sought.

  3. Item 2.3 · Taxes and fees

    Discontinuing the green waste program

    Discussed

City Treasurer Alyson Alger said Waste Management no longer operates a green waste facility. Residents had paid for nine months, but the city has been billed year-round. Beginning in December residents will be charged for all 12 months, an additional $27 a year, and may opt to have the green waste can removed. Letters go out in early October.

    • Fee$27 Added annual charge per household for year-round green waste can

  9. Item 9 · City code

Eliminating the winter overnight parking ban (Ordinance 52-2025)

    Approved with conditions · 5-0

Traffic Engineer Luke Seegmiller said the current ban on overnight parking from Nov. 1 to March 30 covers 150 nights though plows run 15 to 30 days a year, and enforcing it burdens police. The change removes the overnight rule, bans parking during snowstorms and for 48 hours after, and adds a ban when an inch or more of snow or ice is on the road.

Moved by Council Member Chris Condie, seconded by Council Member Heather Newall. Vote: 5-0; unanimous

  10. Item 10 · Zoning

Hammond zone change, 600 W. State Street (Ordinance 45-2025)

    Tabled · 4-1 · 600 West State Street

Justin Hammond proposed rezoning 0.83 acres from Mixed Use to Heavy Commercial for an office warehouse. Council Members Stallings and Newall were concerned about proximity to homes and the broad range of heavy commercial uses; Newall preferred the warehouse to earlier drive-through plans. A resident cautioned against incompatible zone changes. Council Member Hancock and Mayor Johnson suggested a development agreement locking in the office warehouse use with buffering. The council tabled the ordinance and directed staff to craft an agreement allowing office warehouse with no outside storage and buffering for neighbors, possibly leaving the zone as Mixed Use with the added use. Council Member Condie asked whether the applicant was being asked to negotiate for lesser rights. The minutes' narrative says 3-2 but the roll call shows 4-1.

    • Applicant: Justin Hammond
    • Acres: 0.83
    • Current zone → proposed: Mixed Use → Heavy Commercial

Inverness Preliminary Plat D revision: add 12 lots from Plat 6

  13. Item 13 · Annexation

Intent to annex: JDH Olson annexation (Resolution 2025-63)

Approved with conditions · 5-0 · About 1500 South 1100 West (also listed as 7730 North 8730 West)

The council approved a resolution of intent to annex about 5.08 acres at about 1500 South 1100 West with R-1-22 zoning. A neighbor worried about traffic, 100-year-old trees and density; three other neighbors supported annexing the county island and the R-1-22 zoning, one describing the site as a dust bowl.

    • Acres: 5.08
    • Proposed zone: R-1-22

  15. Item 15 · Subdivision

Colledge Farms PRD Plat F concept plan (9 lots requested)

    Approved with conditions · 3-2 · About 2850 West 1500 North

Russ Wilson of Symphony Homes said the existing neighborhood has 98 lots averaging over 18,000 square feet and the new phase would add nine lots with a slightly larger average; R-1-22 allows seven. He asked for two extra lots citing road dedication, landscaping and one lot lost when an owner combined two. Staff supported an eighth lot for road dedication. A resident raised precedent concerns about expanding a planned residential development. Council members discussed HOA impacts and using density in lieu rather than impact fees; Mayor Johnson said impact fees fall short of road needs. A motion by Council Member Condie to deny failed 2-3 (Condie and Stallings yes). The council then approved eight lots, the eighth as density in lieu, 3-2, with Condie and Stallings opposed; Stallings preferred seven lots at the 22,000 square foot standard.

    • Lots approved: 8 (including 1 as density in lieu)
    • Lots requested: 9

Moved by Council Member Paul Hancock, seconded by Council Member Heather Newall. Vote: 3-2; Council Members Chris Condie and Michelle Stallings voted no. Voting no: Council Member Chris Condie, Council Member Michelle Stallings

  17. Item 17 · City code

Detached accessory dwelling unit rules (Ordinance 47-2025)

    Approved · 5-0

The amendment lowers the minimum lot size from 15,000 to 14,520 square feet and limits detached ADUs on slopes over 20%. Engineering staff favored flexibility on steep slopes with proper engineering; Council Member Albrecht cited safety concerns and Council Member Stallings asked about geotechnical requirements.
