Ordinance 2024-12: short-term rental ordinance amendments

The council adopted amendments to rules on residential short-term rentals covering on-site parking, owner occupancy proof, a three-year ownership requirement for non-owner-occupied rentals, and use in commercial-entertainment and H25 zones. Planning staff offered an optional amendment to drop the ban on guests parking on the street within two blocks while still requiring adequate on-site parking; the council adopted the ordinance without it. Council Members Blair and Choberka said they preferred the modified version, and Vice Chair White also voted no; Choberka said parking rules are not equitable across rental and business types. Council Member Hyer said state law makes regulation difficult; Council Member Graf expected the rules to encourage licensing. Speakers split: one said rentals belong in commercial zones, another that they are a high-impact commercial use in neighborhoods, one said only 19 are licensed versus 300 or more listed online, Visit Ogden supported the ordinance, and one asked to table.

The proposal would require on-site guest parking, bar outside visitors during rentals, require three forms of residency proof for owner-occupied rentals, require three years of ownership for non-owner-occupied rentals and allow rentals in the C-ENT and H25 zones. FlashVote's Kevin Lyons said the April survey showed parking is the top nuisance. Staff said better-defined parking rules are needed for enforcement.
