Agenda, item by item

  1. Item 1.A · Presentation

Barr Engineering water and re-use optimization study

    Discussed

Barr Engineering reported total water supply of 30,198 acre-feet a year, sustainable Cedar Valley groundwater of 10,700 acre-feet and 5,885 acre-feet for city wells. Demand is projected to rise from under 10,000 to over 35,000 acre-feet a year by 2060, exceeding paper water rights in 2049 and sustainable supply plus Central Utah Water Conservancy District imports by 2029. Eagle Mountain's rates of $0.50 to $0.95 per thousand gallons compare with $0.96 to $1.59 in Provo and $3.52 to $5.06 in American Fork. Recommendations include rate increases, negotiations with the district, a groundwater study, a secondary water master plan and conservation. Council Member Curtis favored raising rates and repealing the tiered residential system; Council Member Clark asked for separate data on agricultural and residential landscaping use; Council Member Love said the same grass area should not carry different rates.

  2. Item 1.B · City code

Process for amending land use regulations (EMMC 17.05.120)

    Discussed

Staff proposed rules under Utah Code 10-9a-509 for who may request amendments and when a review begins. Council Member Clark wanted two members to be able to request a review and requesters named publicly; Council Member Burnham accepted two members requesting a Planning Commission agenda item but worried two could trigger state-law delays; Council Member Love suggested three members concur on how a review affects current applications; Council Member Curtis was concerned about developer requests.

  3. Item 15.A · City code

Ordinance amending Titles 7, 16 and 17 (tier and bonus density cleanup)

    Approved with conditions · 5-0

The ordinance removes references to tiers and base/bonus density from the repealed Chapter 17.30. The Planning Commission voted 4-0 Nov. 10 to recommend approval with a change of the minimum lot size for long-term home business storage from two to two and a half acres. No one spoke at the public hearing.

Moved by Council Member Jared Gray, seconded by Council Member Colby Curtis. Vote: 5-0

  4. Item 16.A · Development

Marketplace at Eagle Mountain Town Center development agreement

    Approved · 5-0

The agreement for the 39-acre commercial project covers road improvements in four sections, trails, landscaping, turn lanes, streetlights, masonry walls and detention basin improvements, with deeds for the basin relocation and a triangle parcel. Council Member Gray asked that all remaining roads be built with any future phase; Council Member Love wanted both neighborhood accesses installed at once. Staff said the wall location will be set at site plan review, depending on the sale of adjacent city property.

  5. Item 17.A · Development

Approved with conditions · 5-0 · Pony Express Parkway and Porter's Crossing Parkway

The 6.3-acre project at Pony Express Parkway and Porter's Crossing Parkway has Cascade Collision Auto Repair on Lot 1. The closest parking setback to the wash is 21.9 feet. Council Member Gray raised concerns about upward and downward lighting; applicants said the sconces are low-lumen and under an awning. Nine conditions include deeding land north of the wash to the city, revising the plat, lighting code compliance, a full-property landscape plan and traffic study, approval of the Lot 1 site plan, and an eight-foot solid privacy gate and fence around the enclosed parking.

    Tabled · 5-0

The amendment would merge the HOAs, turn the Phase A park into a pool and clubhouse area, and earn 1,003 amenity points against 737 required. The Planning Commission voted 4-0 to recommend approval with a parking condition. Council Member Gray was concerned about lost amenities, the HOA merger and clubhouse size; Council Members Clark and Curtis raised amenity proximity and precedent; Council Member Love noted the pool exceeds the requirement. Developer representatives defended the design. The council tabled the item to determine amenity locations; Council Members Burnham and Clark directed relocating the pool and clubhouse toward Verdant Drive, and a site visit was requested.
