Liberty Treatment Center

A residential addiction treatment center with 43 rooms in the former Bel Aire Senior Living building at about 1088 East 390 South, in the PO-1 zone, where the use is permitted. Because it is a change from the assisted living facility, it needs a new site plan, and the city code has no parking standard for the use. On Oct. 8, 2025 the Planning Commission voted 5-1 to set parking at 0.6 stalls per room, about 26 stalls, instead of staff's roughly 70.

Liberty Treatment Center parking determination, 1088 E. 390 South (1.29 acres)

    Approved · 5-1

Liberty Addiction Recovery Center plans to convert the Bel Aire Senior Living assisted-living building in the PO-1 zone, where the use had been found permitted, into a residential treatment facility for people with disabilities. Because the use is not listed in the parking code (Section 17.5.133), the commission had to set a ratio. Staff recommended five stalls per 1,000 square feet of clinic space plus one per room, about 70 stalls. Attorney Dan McDonald argued the use is most like assisted living (17 stalls by the table) or independent living (0.4 per room) and the existing 25 stalls suffice; operator Roger Williams said it is a social detox with no medical staff and most residents have no licenses or cars. The fire marshal had ruled out extra parking on the adjacent lot. Commissioner Rod Martin, citing personal experience with such facilities, proposed 0.6 per room for 43 rooms; Chair Anderson voted no, saying peak staffing of 25 could spill parking onto the street. City Attorney Heather Shriver said the decision applies only to this application.

    • Applicant: Liberty Addiction Recovery Center (attorney Dan McDonald; Roger Williams)
    • Acres: 1.29
    • Zone: PO-1
    • Rooms: 43
    • Existing stalls: 25
    • Staff recommendation: about 70 stalls (clinic 5/1,000 sq. ft. + 1 per room)
    • Decision: 0.6 stalls per room (about 26)
    • Formal site plan still to be submitted

Moved by Commissioner Rod Martin, seconded by Commissioner Claire Oldham. Vote: 5-1; Chair Christine Anderson voted no

  2. August 6, 2025 · Planning Commission

Liberty recovery residence use determination / reasonable accommodation, 1088 E. 390 South

    Approved · 5-0

The operators of a planned residential addiction treatment program (detox, 30-90 days of inpatient treatment, then a recovery 'step-down' stage) asked for a reasonable accommodation under city code Chapter 17.15 and federal fair housing and disability law to occupy the Bel Aire Senior Living building in the PO-1 zone. Staff (Planner Annalisa Reed) said the use is not listed in PO-1, whose intent covers hospitals, medical clinics and nursing homes. City Attorney Heather Shriever explained the reasonable accommodation test. Applicants' attorney Dan McDonald said the program will have a medical director and clinical director and argued the commission can define 'hospital' or 'medical clinic.' Commissioner Geoff Dupaix pointed to code language allowing uses 'as may be permitted by action of the planning commission or city council'; Commissioner Chris Christiansen said the use fits the definition of assisted living. The commission found the use permitted in the PO-1 zone, which applies zone-wide rather than to this one property. Commissioners said the code rewrite should list the use explicitly.

    • Applicant attorney: Dan McDonald (operator representative Roger Williams attended)
    • Area cited: about 0.17 acres (agenda); later site plan 1.29 acres
    • Zone: PO-1
    • Finding: residential treatment facility for individuals with disabilities is a permitted use in PO-1
    • Next step: parking determination (Oct. 8, 2025)

Moved by Commissioner Chris Christiansen, seconded by Commissioner David Bird. Vote: 5-0
