Rezone of 1360 North 200 West, Ordinance 23-11 (workshop)

    Discussed

Planner Russ Holley presented a request to rezone about 1.8 acres, Lot 6 of the Royal Point subdivision, from MR-12 to MR-20 with a design review for a four-unit building on the vacant 0.24-acre southwest corner. The lot is already developed at about 15.5 units an acre and a 2016 rezone to MR-20 was reversed in 2017. The minutes are contradictory on staff's recommendation and on the Planning Commission's March 9 action. Holley said the rezone would be spot zoning; Council Member Mark Anderson said the question is whether the council wants something or nothing on the site. Action was set for April 4.

About 1.80 acres (TIN 05-041-0056) were rezoned from MR-12 to MR-20. Staff recommended denial and the Planning Commission recommended approval. The applicant said he would commit only to a duplex. Council Members Jensen and Mark Anderson withdrew earlier approvals to amend the motion so the city would pursue a downzone back to MR-12 after the project is built. One written comment from Frank Schofield was received.

Workshop: 1360 North 200 West rezone, Ordinance 24-23

    Discussed

The applicant seeks MR-20 on about 1.80 acres, the Planning Commission voted 4-0 on October 24 to recommend denial and staff recommends denial. The earlier duplex entitlements expired and the request is now for a four-plex, which MR-20 would allow up to 36 units. One comment at the Planning Commission concerned drainage and weeds. Council members noted the property was previously rezoned and then downzoned. Action was set for November 19.

1360 North 200 West rezone from MR-12 to MR-20, Ordinance 24-23 (public hearing)

    Continued · 5-0

The Planning Commission voted 4-0 on October 24 to recommend denial, and staff cited the Future Land Use Plan, the Bridger Neighborhood downzoning goals and consistency of MR-12 with surrounding properties, saying a move from duplex to fourplex is contrary to the neighborhood goal. Discussion covered the lot's 1995 subdivision, earlier rezones and expired permits, and possible deed restrictions. The applicant said he intends to blend with nearby duplexes and is willing to offer a deed restriction; one resident favored no more than a duplex because of parking. The council continued the item to December 3 without a public hearing.

    1360 North 200 West rezone from MR-12 to MR-20, Ordinance 24-23

    Approved with conditions · 5-0

The council adopted the rezone of about 1.80 acres 'as presented' although staff and the Planning Commission (4-0 on October 24) recommended denial; the minutes do not explain the reasoning. The owner signed a deed restriction to downzone the property back to MR-12 after design review, with a January 1, 2026 deadline to submit design review to the Planning Commission. The applicant said the timeline was sufficient and that accessible units were only an idea.
