Item 6 · Development
Riverbend Dental Office-Cook Orthodontics elevation changes
Approved · 4-0
The council approved substantial changes to the site plan building elevations. Nate Nathal, for the applicant, presented an updated design; members said it fit the area.
Item 7 · Subdivision
Skyridge Subdivision concept, 5 lots
Approved with conditions · 4-0
Applicant Brett Ventura downsized the plan to five lots and sought exceptions for park strips, sidewalks and a pedestrian connection to the school. Community Development Director Kim Struthers said the connection reduces school traffic but needs the school's permission; two school authorities gave differing preferences. A first motion to grant all exceptions failed 2-3, with Council Members Newall and Stallings and Mayor Johnson opposed (the mayor cast the deciding vote). Newall said a school response is needed to avoid precedent; Stallings said she would likely vote no but favors a school walkway if the school agrees. The second motion grants the park strip exception, with findings that it fits the neighborhood and the street has no through connection, and requires the city and applicant to obtain a consistent preference from school administration and the district; if the school wants the walkway, the exception is not granted.
- Applicant: Brett Ventura
- Lots: 5
- Exceptions: park strip granted; school walkway exception depends on school preference

Council Member Stallings raised concern about easements limiting owners' rights and declaring private property an easement without agreement. Mayor Johnson said the plat acts as an agreement signed by all parties; City Attorney Ryan Wood said the process is the same as other easements but the area is broader. The motion changes the wording from 'drive' to 'access points and alleyways.' Stallings asked that the minutes record her view that this raises a constitutional takings issue.
