June 29, 2021, 5:30 p.m. · Lehi City Council Chamber, 153 N. 100 East

Agenda, item by item

  1. Item Pre-council 2.1 · Development

Letter of intent for Compass Pointe and Sanctuary

    Discussed

Marlin Eldred told the council the non-binding letter of intent would be the framework for a development agreement and states the city will negotiate in good faith. He said the Redevelopment Agency would still need to approve any tax increment. No vote was taken.

  2. Item Pre-council 6 · Other

    Closed executive session

    No action · 5-0

The council voted to close the meeting to discuss the purchase, exchange or lease of real property and pending or reasonably imminent litigation. No action was reported.

Moved by Council Member Chris Condie, seconded by Council Member Katie Koivisto. Vote: Unanimous, 5-0

  3. Item Pre-council 2.2 / 19 · Public safety

Fireworks restrictions due to drought (Ordinance 29-2021)

Approved · 5-0 · Mapped restricted areas citywide; four city parks open for fireworks

Fire Chief Jeremy Craft proposed restricting fireworks in mapped areas of the city because of drought, while opening four city parks for residents in restricted areas. The Fire Department would skip its early-morning salutes, and Craft encouraged residents to attend a professional show instead. The council approved the ordinance as presented.

Moved by Council Member Mike Southwick, seconded by Council Member Paul Hancock. Vote: Unanimous, 5-0

  4. Item 15 · Subdivision

    Lehi Tech Office Condo Conversion

    Approved with conditions · 5-0 · 300 South 1350 East

The council approved a condo conversion at 300 South 1350 East. Applicant representative Pete Evans asked that a Development Review Committee comment requiring UDOT permission be removed so the plat could be recorded sooner, saying the city would still be protected by the bond. The motion was amended to allow recording before the UDOT comment is resolved.

    • Conditions: DRC and Planning Commission comments; plat may be recorded before the UDOT comment is resolved

  5. Item 4 · General plan

Micron Area Plan concept approval (tabled from June 8)

Approved with conditions · 5-0 · Micron Area Plan, near SR-92 and Highland

The council untabled the item. DR Horton's Scott Bishop said the plan now puts open space on the west side as a buffer between current residents and the active adult zone, and changes the 'triangle' piece to open space; he presented a fiscal analysis showing better amenities though less acreage of open space. Council Member Paul Hancock said the 580 units on the east side are tied to the county land and would go to whichever city annexes it. Assistant City Engineer Brad Kenison said the plan encourages an east-west connection, which lies in Draper, and explained that unit counts were based on sewer capacity. Residents commented on maintenance of the 'panhandle', trail access, traffic and buffer distance; several supported making the triangle open space. The council approved the concept with the triangle designated open space on all maps (a park is possible later), the east-side units adjusted to 597 based on engineers' calculations, and the developer to work with staff on panhandle maintenance.

    • Applicant: DR Horton
    • East-side units: 597
    • Triangle parcel: open space on all maps, possible future park

  6. Item 5 · Subdivision

X Development 2100 North Subdivision concept

    Tabled · 5-0 · About 2100 North 2300 West

Erin Towner, for the applicant, proposed a 65-lot development with 32-foot private drives (28 feet of asphalt, allowing parking) and 20-foot driveways, and asked for 66 lots as a density bonus in lieu of trail improvements. The main question was whether to seek an access to 2100 North; the applicant had removed it, saying it may not be legally required and neighbors did not want it. Staff considered the access important for connectivity, and the city attorney said code requires it unless UDOT denies it, though the council could waive it in a development agreement. The mayor asked for a traffic analysis and noted a neighboring subdivision lacks such access. Residents split: some feared the access would be used to bypass an intersection and endanger children, others said it should be required. The council tabled the item, directing a traffic study, staff determination of bonus lots, and a possible development agreement if the access is found unnecessary.

    • Applicant: X Development (Erin Towner)
    • Lots: 65 proposed; 66 requested with bonus

  7. Item 6 · General plan

General plan amendment at 1700 West 1500 North (Ordinance 25-2021)

    Denied · 5-0 · About 1700 West 1500 North

Steve Tripp asked to change 13.05 acres from Very Low Density Residential Agriculture to Very Low Density Residential, saying 22,000-square-foot lots were not desirable. Council members wanted to keep the larger-lot, open feel and worried about infrastructure effects of small changes. Two adjacent owners opposed. The council denied the request, finding that adding density in agricultural zones takes capacity from areas better suited for it, such as transit corridors.

    • Acres: 13.05

Lewis Flex Office zone change (Ordinance 26-2021)

    Approved · 5-0 · About 4100 West and 2100 North

Applicant representative Howard Cook said the user is not yet determined. The mayor said many emails worried about semi-trucks and manufacturing, and had the community development director explain that Heavy Commercial allows office-warehouse, citing the Blender Bottle building as an example. One nearby resident opposed manufacturing or an auto dealership. The council noted the zone fits the general plan and approved the change.

    Approved with conditions · 5-0 · 2029 West 900 North

Jacob Hansen represented the applicant. The city attorney said redline changes were presented that night. The agreement mostly grants exceptions to setbacks and height in the current zone. Council Member Chris Condie asked for a fence or landscape buffer for the one house to the west, since a school has bought land there. The council approved it with the staff redlines and a requirement that the applicant work with staff and that neighbor on screening.

Liz Anderson asked that the Peck name be reinstated on Family Park. On the Micron plan, residents raised landscape maintenance on the 'panhandle', traffic and buffer width, and several backed open space on the triangle. On the 2100 North subdivision, residents disagreed over requiring a 2100 North access, citing child safety and bypass traffic versus connectivity. Two neighbors opposed the 1700 West 1500 North change, and one resident opposed manufacturing under the Heavy Commercial zone.
