May 26, 2020, 4:00 p.m. · Online (www.lehi-ut.gov)

The Lehi City Council, meeting online, unanimously approved concept plans for Willow Point (420 lots) and Timp Point (200 lots) after discussing whether to wait for in-person public comment; Council Member Katie Koivisto said she voted yes because of the developer's vested rights. It adopted the fiscal year 2021 budget and fee schedule 4-1, approved the Goulding Annexation Agreement for a transit-oriented development, and approved contracts for Main Street widening, parks design, slurry seal and pipe relining.

  3. Item 3 · Development

Willow Point concept plan, 420 lots

Approved with conditions · 5-0 · Approximately 4100 West Hardman Way

Kim Struthers asked that utility easement issues be resolved at preliminary plat. Koivisto relayed many resident emails asking to table the item until residents could comment in person; Council Member Mike Southwick said the council had asked for emails or online comment and tabling would be special treatment, and Council Member Paige Albrecht said she was surprised residents had not used that option. Mayor Mark Johnson said a concept plan covers layout, colors and architecture because density was already set by a development agreement that lets the developer place a set number of homes in the commercial zone. Applicant representative Brandon Watson said the design adds walkability and varied color schemes; Albrecht urged design variation. Koivisto asked that the developer seek a positive recommendation from the Timpanogos Special Service District; Council Member Chris Condie, City Attorney Ryan Wood and City Engineer Lorin Powell said that district is not a land use authority and capacity planning is the city's job. Wood said the development agreement's rights are now vested.

    • Lots: 420
    • Condition: address utility easements at preliminary plat
    • Koivisto said she voted yes because of the developer's vested rights

Discussed with item 3. Watson said an access could be added to address a block-length exception, and surface materials and color schemes would vary; Mayor Johnson wanted more variation. Koivisto again said she voted yes because of the developer's vested rights.

    • Lots: 200

Moved by Council Member Mike Southwick, seconded by Council Member Chris Condie. Vote: Unanimous, 5-0

  5. Item 5 · Annexation

Goulding Annexation Agreement, 55.37 acres, TOD zoning (Resolution #2020-37)

Approved with conditions · 5-0 · Approximately 3000 West Traverse Mountain Boulevard

Applicant representative Jerrod Morgan said that if no public transit station is built, the developer would want the donated land returned and would return with a different plan. Albrecht and Council Member Paul Hancock were concerned density was already granted for the donated 6 acres; Hancock wanted it to be a park or open space if no station comes. Wood said the city is not obligated to give additional density in place of a station. City Administrator Jason Walker noted the agreement omits an earlier motion keeping park impact fees in the development, so the council can use them at its discretion. The motion added that at 20 years, if no station is built, the developer and city meet to decide the best use of the station property, which could be open space.

    • Acres: 55.37
    • Zoning: TOD with TOD land use plan
    • About 6 acres of public land dedicated to the city

Moved by Council Member Paul Hancock, seconded by Council Member Katie Koivisto. Vote: Unanimous, 5-0

  8. Item 8 · Budget

Fiscal year 2021 budget and consolidated fee schedule (Resolution #2020-32)

Lundell preferred adopting the budget as proposed and adjusting later if needed. Condie's motion adopted it, lets staff work with elected officials on adjustments based on economic data, and put the merit increase of up to 4 percent into effect July 1 rather than delaying it to save money. Mayor Johnson said he would prefer to keep the option of delaying merit increases. Koivisto voted no; the minutes record no reason.
