  1. June 18, 2025 · Planning Commission

Storm water management and discharge control code update (Section 13.94), corrected version

    Recommended for approval · 5-0

Storm Water Manager Tyler Mezenen said this was the same state-mandated update recommended May 21, 2025, but a miscommunication with the city attorney had marked some existing code for removal by mistake; the original language was restored and the amendment now changes only subsections 13.94.090 and 13.94.100. The changes adopt standardized state documents, clarify owners' duty to control runoff, add a storm water inspection process and follow-up before citations, and reduce when a land disturbance permit is needed. No public comment.

    • Initiated by city staff
    • Sections: 13.94.090, 13.94.100
    • Reason: changes in state storm water law

Moved by Commissioner Rodney Martin, seconded by Commissioner David Bird. Vote: 5-0 (Commissioner Frandsen not yet present)

Storm water management and discharge control code update (Section 13.94)

    Recommended for approval · 6-0

City Engineer Ben Hunter and Storm Water Supervisor Tyler Mezenen said state law changes require standardized storm water documents statewide, a state fee schedule for violations instead of routine stop-work orders, clearer owner responsibility for runoff and fewer cases needing land disturbance permits; stop-work orders remain for threats to public health or water quality. Commissioner Bruce Frandsen said oil and chemicals from road runoff reach land he farms and asked the city to address it and to exempt farming and ranching; Hunter suggested a separate code change. Amended subsections 13.94.020, .030, .070, .090 and .100. A corrected version returned June 18, 2025.
