Cahoon Street partial vacation (F to G avenues)

Request to vacate 137.9 feet (9,320 sq. ft.) of Cahoon Street for a mixed-use project, opposed by staff and the Planning Commission because the city wants the right-of-way for a water line near the I-15/24th Street interchange. The council extended it on Feb. 20, 2024 and denied it 4-3 on April 9, 2024; the mayor offered to work on fees for a future petition.

Proposed partial vacation of Cahoon Street between F and G avenues (work session)

    Discussed

Planning Manager Barton Brierley said the petitioners want to vacate 137.9 feet of right-of-way (9,320 square feet) and that the Planning Commission recommended denial, finding a potential for material injury to the city's ability to plan utilities. A representative of the McClary Company presented the owners' concept plan, historic vacations of other parts of the street and projected tax revenue. Council Member Graf said the city plans a 24-inch water line while the petitioners proposed 16-inch, and called the project great in concept but said staff and commission concerns needed to be reconciled. A Planning Commissioner told Council Member Hyer the commission heard some rerouting options but Cahoon Street was the preferred water-line route. Staff scheduled the public hearing for Feb. 20.

Partial vacation of Cahoon Street between F and G avenues

    Continued · 7-0

After a public hearing, the council voted to extend consideration rather than act on the Planning Commission's recommendation of denial. Staff and the commission said the right-of-way is needed for a planned water line and UDOT's I-15/24th Street interchange plans are not final. Petitioner representatives said the city's position was punitive, offered an easement and proposed rerouting options. Speakers Travis Pate and Angel Castillo opposed vacating now; the owner and others said they wanted to work with the city. Council Member Hyer said he would deny if forced to act now but was willing to extend if negotiation was possible; Council Member Myers called the project great but said water infrastructure had to be accommodated. No return date was set, and affected owners will be re-noticed.

    • Plan: mixed-use project, commercial below and residential above
    • Current zoning: R-1-5 and C-3; a rezone would be needed later
    • Planning Commission (Dec. 6, 2023): recommended denial

Moved by Council Member Richard Hyer, seconded by Council Member Shaun Myers. Vote: 7-0

Communication plan for Cahoon Street partial vacation

    No action

Policy Analyst Steve Burton reported City Engineering cannot support the vacation while UDOT's I-15 interchange plans are unsettled, with a UDOT meeting set for later in March. Staff proposed another work session afterward and placing the petition on the April 9 agenda, with notice to affected owners.

  5. April 9, 2024 · City Council

Partial vacation of Cahoon Street between F and G avenues (extended from Feb. 20)

    Denied · 4-3

After a public hearing the council denied the vacation of 137.9 feet (9,320 sq. ft.) of right-of-way. Staff and the Planning Commission had recommended denial because the street is needed for utility planning around the I-15/24th Street interchange. The petitioners' representative said the site plan was reworked into two phases and asked for another extension. Council Members Hyer and Choberka favored tabling or extending until UDOT finalizes interchange plans; Hyer noted that would save the petitioner a new fee. City Engineer Taylor Nielsen reported UDOT said it will not reach the 'plan in hand' phase until September or October 2024, and Mayor Nadolski said he supported extending but offered to consider reducing or waiving a future petition fee if the council acted now. Council Member Graf moved to deny; Vice Chair White also voted no. Speakers Travis Pate, Angel Castillo, Alan Jones, Teresa Bramwell and owner Tyler Gray favored extension. Council Member Blair thanked the mayor for the fee offer.
