Watermark rezone, Ordinance 22-21 (workshop)
Discussed
Planner Russ Holley presented a request to rezone about 11.13 acres at 1262 West 2200 South from Commercial to Mixed Residential High (MR-30) with a design review for 232 units: 28 townhomes and 204 condominiums. Parking is 34 stalls, about 8 percent, short. Staff recommended denial, finding the request inconsistent with the 2008 future land use plan and with neighboring uses. The Planning Commission's recommendation is not recorded. Amy Anderson asked whether the proponent's verbal intent to sell condominiums is binding; Holley said no. Action was set for December 6.

The council denied the rezone of about 11.13 acres at 1262 West 2200 South from Commercial to MR-30 for 232 units. Staff recommended denial because the request is inconsistent with the 2008 future land use plan and parking is 34 stalls short. Melani Kirk, principal of Thomas Edison Charter School, opposed the density, citing traffic and more than 700 students picked up and dropped off; Kent Smith of Nibley opposed a high-rise beside a school. Council Member Tom Jensen said denial would not change existing density under current zoning. Members concluded the project was well designed but in the wrong location.
