Workshop: Riverside RV Park rezone, Ordinance 21-11

    Discussed

The applicant asked to rezone about 4.7 acres from Recreation to MR-20 for townhomes, up to 94 units. Staff recommended denial and the Planning Commission voted 6-1 to deny on April 22. The site is mostly in the FEMA floodplain. Jensen said buildings would need to be elevated and fill could worsen downstream flooding but suggested not excluding the project if risks can be mitigated; Simmonds disagreed that this density belongs in a high-risk area and said she would support only a recreational zone; López said he understood the owner's frustration.

Riverside RV Park rezone, Ordinance 21-11

    Denied · 3-1-1

The council denied a rezone of about 4.7 acres at 447 West 1700 South from Recreation to MR-20. Staff and the Planning Commission (6-1) recommended denial, citing zoning history, the floodplain and a proposed FEMA floodway revision. Jensen said floodplain issues can be mitigated by engineering and are not enough reason to deny. City Attorney Kymber Housley said that once a legislative zoning decision is made the council's discretion is largely gone. No one spoke at the hearing. The motion was to deny.
