Rezone of 920 North 200 West, Ordinance 25-23 (public hearing)
Approved with conditions · 4-0
The council adopted the rezone of 2.52 acres from MR-12 to Community Commercial rather than the Commercial zone the applicant requested. Staff recommended denying COM and approving CC, and the Planning Commission voted 6-0 to recommend denying COM. The applicant said the property has been nonconforming since 1983 and accepted CC. Planner Aimee Egbert said the applicant and others were targeted by scam emails claiming approval and demanding a fee. Council members Amy Anderson, Johnson and López worried about a higher zone if the property sells; Chair Simmonds said the location suits CC. City Attorney Craig Carlston said the council could approve CC because it is lower intensity, whereas returning to the Planning Commission would take seven to nine weeks.

Discussed
YABC, LLC asked to rezone 2.52 acres in the Bridger Neighborhood to Commercial, to allow an 8-foot perimeter fence and future building expansion and convert the building to offices. Staff recommended denying COM and approving Community Commercial instead, noting COM allows about 45 permitted uses including gas stations and pawn shops. The Planning Commission voted 6-0 on November 13 to recommend denial. A 1997 conditional use permit remains valid. Action was set for December 18.
