Interlocal agreement with the Utah Inland Port Authority
Approved · 7-0
The Council adopted Resolution 35 of 2022 authorizing the Mayor to sign an interlocal agreement with the Utah Inland Port Authority, required by 2022 legislation to be in place by Dec. 31, 2022. It sets how the Authority spends environmental and community mitigation money and consults the City, commits the Redevelopment Agency to spend 10 percent of exempt-area property tax it receives on affordable housing, and requires the City to provide a point of contact for land use applications. Council Member Petro-Eschler thanked the City Attorney, Mayor and chief of staff; Council Member Puy said the Port would proceed without a contract and the agreement gives the City protection. Council Member Wharton noted the City's lawsuit lost at the Utah Supreme Court and cited the agreement's required environmental and health studies. About eight speakers in public comment opposed the agreement, asking for a delay for public input, objecting to the 25-year term and to the Port's property tax and water use, and asking for an environmental health study. The Redevelopment Agency board separately approved Resolution 16 of 2022 on the same agreement, 7-0.
