    Consent: public hearing dates set

    Approved · 6-0

The Council set February 7, 2023 hearings on the rezone at about 704 East 900 South, the Rocky Mountain Power rezone at 1223 West North Temple, the ADU text amendment and a land exchange at 592 N. Riverside Drive for the Bridge to Backman project; set a February 21 hearing on the Urban Forest Action Plan; and set a March 7 hearing on landscape material (turf) limits. The Planning Commission forwarded a negative recommendation on the 704 East 900 South rezone, so no ordinance had been drafted. The Riverside Drive exchange would transfer open space for $0 to Riverwood Cove, LLC for another open space parcel of equal size, to enable a public park, outdoor classroom and a walking and biking connection to Backman Elementary and to resolve an encroachment.

Zoning map amendment at about 704 East 900 South

    Discussed

The proposal would rezone a 0.24-acre property from R-2 (single- and two-family residential) to SNB (small neighborhood business) so that dwelling units added without permits could be brought up to code. Planning staff recommended approval, citing the Central Community Master Plan and zoning of other corner properties; the Planning Commission recommended denial, saying the request was not consistent with Plan Salt Lake and would not reduce congestion. The property is under enforcement for short-term rental use of three units. Council Member Petro asked whether a development agreement could ensure the existing home is preserved; staff said one was recently used for another rezone. Council Member Puy asked whether non-compliance fees could be paused; the City Attorney said fees are a separate process and she would report back.

    Tabled · 7-0

The hearing covered a request to rezone 0.24 acres from R-2 to SNB so units added without permits can be brought up to code; the Planning Commission forwarded a negative recommendation. A speaker for a housing advocacy group urged flexible zoning and maximum use of the property. A neighborhood organization chair read a letter of support listing recommended considerations. Two residents opposed, citing parking and unintended consequences, and one raised concern about investors seeking zoning above what is typical for the neighborhood. Another speaker said a commercial zone could lead to demolition of the house and urged protecting it. The Council closed the hearing and deferred action.

Staff said the applicant agreed the property would not be used for short-term rentals. Members asked whether the agreement runs with the property and said the motion sheet needed clarification on the number of units.
