Proposed rezone of 1201 16th Street from R-2 to R-2S/CO

    Discussed

Assistant Planning Director Joe Simpson described a request to rezone about four acres from R-2 to R-2S with a conditional overlay for 42 single-family row houses under a development agreement that would require owner occupation for 10 years after completion. He said current R-2 zoning could allow about 63 units, that the plan fits the Canyon Road Community Plan, and that the agreement would revert the zoning to R-2 if performance deadlines were missed. The Planning Commission recommended approval 6-0. Vice Chair Graf raised Planning Commission comments about connectivity to the western neighborhood and sidewalks.

    Ordinance 2026-3: rezone 1201 16th Street from R-2 to R-2S/CO

    Approved · 7-0

The Council rezoned 3.71 acres to allow 42 single-family townhomes platted for individual ownership, with a deed restriction requiring owner occupancy for 10 years and a development agreement that reverts the zoning if studies find insurmountable problems. The Planning Commission had recommended approval 6-0. Applicant Gardner Francis said R-2 could allow 63 units, that 16th Street carries about 3,000 of a 6,300 daily vehicle design capacity, and that the project would add about 250 trips; he showed a plan with added visitor parking. Residents opposing cited parking, traffic safety, access through the River Glen private streets and neighborhood character; supporters cited housing need and owner occupancy. Council Member Lopez suggested tabling for more community outreach. Members Richey, Lundell and Myers and Vice Chair Graf supported moving forward, noting later review steps and that the rezone alone does not set design details. Public comment: immigration facility, clean energy program and other issues

    Discussed

Residents asked for a compliance review, fire inspection and written determination on the conditional use permit for the federal immigration facility at 2487 South 1620 West. On the clean energy program, supporters cited choice, cost savings and sustainability; opponents objected to the opt-out structure and asked about transparency and cost. Other speakers raised Weber County Sheriff funding, 287(g), parking at a proposed 16th Street townhome project, and water. Mayor Nadolski said the administration could not substantiate overnight holding or hours violations and would seek permission for a fuller fire inspection. Council Member Lundell said staff made a drive-by inspection. City Attorney Gary Williams said the supremacy clause limits local ability to obstruct core federal functions.
