OBOK Condominiums, 1600 North and 400 West

A proposed high-density mixed-use project of up to six or seven stories at the corner of 1600 North and 400 West in the North Village District, with ground-floor commercial space. Residents have questioned its traffic study, access and parking, and the city has asked for an expanded traffic study.

Work session: North Village District traffic study, parking and height

    Discussed

A city staff member said recent traffic impact studies for the district show resident concerns the city agrees with, that some pre-COVID numbers look low, that more intersections will be added, and that a new submittal will include accident data. If numbers come back worse than expected, staff would look at mitigation such as deceleration lanes. Council Member Terry Peterson said he was concerned about inadequate parking at other apartment complexes. Council Member David Spencer said the proposed zone was becoming too compartmentalized and did not match the State Street Master Plan, and asked how to pause development of the district until parking, zoning and height are resolved. He moved to hold a special council meeting to reopen the zone and Peterson seconded, but the City Manager said motions cannot be made in a work session. The mayor asked Spencer and Peterson to write up their proposed changes and how they would be made.

Work session: North Village District design and parking standards

    Discussed

The council discussed the process for amending Sections 22-24-5(F) and (H) on design and parking standards in the North Village District and holding a special meeting for public and council to exchange views. Planning staff reviewed outstanding issues: traffic study, parking, height and setbacks, and said a recent parking study shows more than enough parking under current requirements.

North Village District height and parking standards

    Continued · 6-0

Staff proposed a maximum height of 60 feet in the NVD-Core, NVD-Edge and NVD-Res(A) zones, taken from the C2 zone that previously applied, in addition to existing limits (35 feet within 70 feet of a residential zone, setback at least equal to height, 35 feet in Res(B)). They also proposed raising parking in NVD-Core and NVD-Edge from 1.75 to 2 spaces per unit over base density; the current standard was adopted October 8, 2019 using the 2019 parking study. About 20 people spoke. Most opposed the planned development, citing traffic, child safety, parking and the zone's small-scale purpose; requests included a 48-foot limit and 35-foot setback, and 35 feet in the edge zone. An attorney for nearby residents read state law on how councils may adopt or modify planning proposals. One landowner said family property in the zone was rezoned without notice and her taxes rose, and another speaker said a more profitable use such as a car dealership would be possible. Council Member Jeff Lambson said the council should consider how a project looks from the neighborhood behind State Street. Council Members Terry Peterson and David Spencer asked for 48 feet in the core and 35 in the edge zone and to vote that night, but the deputy city attorney, other staff and members warned that a change this different had not been noticed and could invite legal action; Spencer said he would accept that risk. He moved instead to continue to a special meeting on July 27.

    • Staff proposal: 60-foot maximum height; 2 stalls per unit in NVD-Core and NVD-Edge
    • Resident and council member requests: 48 feet in core, 35 feet in edge; setbacks up to 35 feet
    • Continued to special City Council meeting July 27, 2021

Moved by Council Member David Spencer, seconded by Council Member Terry Peterson. Vote: 6-0 of council members to continue; Mayor Richard Brunst voted no
