Council approves annexation agreement for 13 acres on 200 South and banks two water rights

September 12, 2023, 7:00 p.m. · American Fork City Hall, 31 N. Church St.

The council approved an annexation agreement for AF Utah LLC's roughly 13 acres along 200 South, to be zoned transit-oriented development with right-of-way dedicated for 200 South and ground-floor commercial required along that road. It denied a homeowner's request to vacate a rear-yard utility easement, offering an encroachment agreement instead, and approved water banking agreements for 14 acre-feet with Layne Downs and 10.6 acre-feet with Opp-Prop LLC. Two lifeguards who revived a child at the Fitness Center pool received HERO Awards.

  3. Item CC 3-5 · Other

Bennion easement; Nori Sushi liquor license; payments

    Approved · 5-0 · 93 N. 960 East; 821 N. West State St.

Accepted an easement from Donald and Amy Bennion at 93 N. 960 East (to bring their new home into code compliance; Shelton urged revisiting easement requirements in established areas), approved an alcohol license for Nori Sushi Bar and Grill at 821 N. West State Street, and ratified Aug. 16-Sept. 5 payments.

Moved by Council Member Clark Taylor, seconded by Council Member Staci Carroll. Vote: 5-0

  4. Item A1 · Other

Utility easement vacation request, 1051 N. 700 West Circle (Searle Meadows Lot 25A)

    Denied · 5-0 · 1051 N. 700 West Circle

Staff recommended denying the vacation and granting an encroachment agreement, with the owner installing conduit at their own expense for possible future telecom use. Shelton saw no need for the easement since utilities signed off and wants easement code strengthened.

Moved by Council Member Clark Taylor, seconded by Council Member Staci Carroll. Vote: 5-0; motion denied vacation and authorized an encroachment agreement

  5. Item A2-3 · Contract

    Water banking agreements: Layne Downs (14 acre-feet) and Opp-Prop LLC (10.6 acre-feet)

    Approved · 5-0

    • ContractAmount not given to Opp-Prop, LLC Water banking, 5.30 shares (10.6 acre-feet)
    • Layne Downs: 14 acre-feet

Moved by Council Member Rob Shelton, seconded by Taylor; Carroll. Vote: 5-0

  6. Item A4 · Annexation

AF Utah LLC annexation agreement, about 13 acres at about 6899 W. 7750 N. (county address)

    Approved · 5-0 · About 1000 W. 200 South (county address 6899 W. 7750 N.)

The property will come in under TOD zoning; the agreement requires right-of-way dedication for 200 South and outlines district densities. Ground-floor commercial is required along 200 South when buildings are built. Shelton asked whether open ditches should be piped before development and hoped development would come soon so 200 South right-of-way is not held up.

    • Acres: about 13 (14.9 at final annexation)
    • Zone: TOD

Moved by Council Member Staci Carroll, seconded by Council Member Kevin Barnes. Vote: 5-0

What residents said

No one spoke in public comment or at the hearing on the Searle Meadows easement vacation. Mike Deuel, for the applicant, said the owner would pay for conduit to get approval for a retaining wall.
