    Continued · 4-3

DAI asked to rezone 10.07 acres from R-1-40A to PUD(12). The Planning Commission did not forward a positive recommendation. Nate Shipp and Joe Salzbury of DAI presented a revised plan with 20 fewer units and more open space, and Council Member Monica Zoltanski shared the results of a resident survey. The council first voted 5-2 to dispense with reading the emails aloud, with Zoltanski and Marci Houseman opposed. Council Member Brooke Christensen then moved, seconded by Council Member Kris Coleman-Nicholl, to pursue a development agreement based on PUD(10) and the concept plan, to return within eight weeks; the minutes record that motion as failing by a roll call of 5-2 with Christensen and Coleman-Nicholl 'dissenting,' which does not reconcile with the outcome, so the roll call is not reported here. Council Member Cyndi Sharkey moved, seconded by Houseman, to not adopt Ordinance 20-04 (deny the rezone) and withdrew it with Houseman's consent. Zoltanski suggested a PUD(8) option and Shipp said DAI needed more time to review it. Sharkey and Houseman then moved to remand the application to the Planning Commission for a PUD(10) version with the submitted concept plan, as soon as possible; it carried 4-3, with Christensen, Coleman-Nicholl and Zoltanski opposed.

    • Applicant: DAI (Nate Shipp, Joe Salzbury)

    • Planning Commission: no positive recommendation

Moved by Council Member Cyndi Sharkey, seconded by Council Member Marci Houseman. Vote: 4-3 on the motion to remand to the Planning Commission; Council Members Brooke Christensen, Kris Coleman-Nicholl and Monica Zoltanski voted no

    Approved with conditions · 6-1

DAI asked to rezone 10.07 acres from R-1-40A to PUD(10); the Planning Commission gave a unanimous positive recommendation. Jake Warner presented for the city with DAI representatives Nate Shipp, Joe Salisbury and Ryan Hales. Supporters included John Crofts, who cited affordable housing, and about eight others. Opponents or those opposed as proposed raised density, traffic, water pressure, height and a preference for single-family homes or a PUD(8); two speakers wanted more information on height. Written comments read by staff called the project too dense, raised school and sewer concerns, or preferred single-family homes and a park. Council Member Brooke Christensen's motion to approve the ordinance with conditions died for lack of a second. A motion by Council Member Monica Zoltanski, seconded by Stroud, to deny the PUD(10) application failed 5-2, with Council Members Kris Coleman-Nicholl, Zach Robinson, Marci Houseman, Cyndi Sharkey and Christensen opposed. Stroud, seconded by Coleman-Nicholl, then moved to approve Christensen's earlier motion, which carried 6-1 with Zoltanski opposed. Under it, Ordinance 20-04 does not take effect until published, and the city recorder may not publish until the Community Development Director and City Attorney certify that permits were applied for and approved or that the council accepted revisions; if that does not happen by Nov. 1, 2021, the ordinance is void.

The Orchard at Farnsworth Farms: site plan review of changes, 11237 S. 700 East

    Discussed

Craig Evans of Community Development reviewed the application, the Planning Commission's decisions, the revised concept plan and a spreadsheet of changes from the original submittal. The packet laid out three options: accept the revisions to Exhibit A and amend Ordinance 20-04 to extend its Nov. 1, 2021 deadline, neither accept nor reject them and extend the deadline with a requirement that the council be advised after final administrative review, or reject them and let the time expire. The item was informational and no action was taken; a public hearing was set for a future meeting.

Craig Evans presented Ordinance 21-30, which rezones about 10.07 acres from R1-40A to PUD(10) under Option 1 for the project previously approved in November 2020.
