Appeal of final site plan approval for Block D, Holladay Hills

    Denied · 6-0

A nearby resident appealed approval of a seven-story Block D, arguing the 2007 Site Development Master Plan allows four or five stories and that residential square footage exceeded the plan's maximum by about 35%. The developers, Millrock Capital and Woodbury Corporation, bought the site from Howard Hughes Corporation and said they had invested tens of millions of dollars. Council members debated whether the story limits or the 90-foot height limit controls and the meaning of a "/" in the plan; the city attorney noted ambiguity in a regulation is construed in favor of the property owner, and the mayor said the 90-foot limit controls. The motion rejected the appeal and directed that a written decision be prepared.

    • Applicant: Millrock Capital and Woodbury Corporation
    • Height limit cited: 90 feet
    • Residential units cited: 614 (minutes say they need not be placed in Block D)
    • Staff, Technical Review Committee and Planning Commission found the plan compliant

Moved by Council Member Paul Fotheringham, seconded by Council Member Sabrina Petersen. Vote: 6-0 to reject the appeal; the minutes record the mayor voting; four votes were needed to sustain it

City manager report: finances, legislation and raccoon program

    Discussed

Through January 31, property tax receipts were 97.1% of budget, sales tax 53.5% at five months, franchise tax about 33.7% and intergovernmental revenue 85.9%, driven by CARES Act funds; building permit fees were high mainly due to Block D of Holladay Hills. A transportation funding bill gives Holladay about $300,000 a year for 15 years, about $4.5 million. The city will not continue its raccoon program, which trapped 101 raccoons in five years at about $7,000 a year. Salt Lake County moved to moderate COVID-19 transmission risk.

  4. April 14, 2022 · City Council work session

Work meeting: bond project update and Holladay Hills agreement

    Discussed

Direction was to proceed with the bond at the originally anticipated amount; the minutes cite both $18 million and $19 million at different points. Staff reviewed proposed changes to the tax increment, site development master plan and Agreement for Development of Land (ADL) for Holladay Hills, to be considered later. The minutes mention a tax increment base value of $34 million, compared with a 2008 assessment of $41 million, and stormwater projects of about $10 million.

    Discussed

As of the meeting, 250 homes were built, 50 under construction and 105 entitled; office space was about 25% of the 100,000 square foot requirement and retail about 20,000 of 60,000 square feet. Work meeting: affordable housing at Holladay Hills

    Discussed

The 2008 area requires 100 units at or below 80% of area median income, 50 of which were delegated to the developer for 20% of increment. The new proposal would commit all 100 units in Block D in exchange for that 20% plus $2.5 million from the RDA ($500,000 from Cottonwood Mall increment and $2 million from reserves). The mayor questioned the termination paragraph and a $3 million increment reference. Council Members Gray and Fotheringham were supportive of the concept and use of funds.

Four open items remain. The mayor suggested a hearing Dec. 11 and a vote Dec. 18. No vote.

Public hearing: Royal Holladay Hills affordable housing agreement (Block E)

    Continued

The 2008 master plan and development agreement require 100 affordable units funded partly by tax increment. Developers first planned them in Block D and asked to move them to unbuilt Block E. Terms include a $2.5 million item with interest-reduction language and $2 million of Millrock project area funds to be spent by May 1, 2029, schematics agreed by June 30, 2026 and construction start by May 1, 2028. Mayor Dahle said the city cannot force developers to meet residents of another block; Council Member Fotheringham said the council preferred Block D but wants to accommodate the change; Council Member Gray said the 25-year term was a miscommunication and the agreement keeps 20 years. The hearing was left open and carried to the next meeting.

Resolution 2025-37: agreement among the city, Redevelopment Agency of Holladay and KMW Development relating to affordable housing at Royal Holladay Hills

    Approved · 6-0

The city requires 100 units, moved from Block D to unbuilt Block E. Mayor Dahle said homeowners association and amenity issues are not city matters. Council Member Fotheringham said the $2.5 million city loan is restricted, is forgiven as units are built and deed-restricted and is callable if they are not delivered, and that he would consider later amending the agreement to use Block D for 80% area median income units. Council Members Brewer, Durham and Quinn said a 30-day delay would not change the city's obligations or the structure; Council Member Gray hoped the developer would work with Block D residents.
