  1. September 1, 2022 · City Council

Ordinance 2022-25: Fox Tail Trail subdivision

    Approved with conditions · 4-0

Creates a 3.8-acre lot and a 29-acre Recreation and Open Space parcel to be deeded to the city, with a new condition limiting open space use on the lot and a deed restriction prohibiting transient occupancy. Dickey and Rubell were concerned about mixed zoning on the lot; Doilney said the owner had met every request. A neighborhood association representative opposed the project as a land grab. The motion limited the lot to the Estate-zoned portion and included 0.76 acres in the dedication.

Moved by Council Member Max Doilney, seconded by Council Member Ryan Dickey. Vote: 4-0

  2. July 21, 2022 · City Council

Ordinance 2022-25: Fox Tail Trail subdivision

    Continued · 5-0

Proposes a 3.8-acre single-family lot from a parcel that also holds a 28.94-acre Recreation Open Space parcel, with a 12-month minimum rental period, a 28-foot height limit and dedication of the remaining open space to the city. The cut-through trail would be removed and a split-rail fence added. A neighborhood association representative opposed the roughly 10,000-square-foot house (nearby homes are 8,000 to 9,900 square feet) and the loss of the trail, and asked the city to buy the open space. Gerber said 10,000 square feet was excessive but met code and the city cannot cap house size; Doilney said the applicant met the requirements and the Planning Commission recommended approval, and opposed making a habit of continuing items; Dickey and Rubell defended council oversight.
