Warner presented a request by Ben Child of Stanson Development to rezone 0.65 acre on 1000 East, annexed in 2025, from R-1-10 to RM(12). The concept plan shows six housing units. A neighborhood meeting was held Jan. 21 and the Planning Commission forwarded a positive recommendation after significant discussion of the lack of improvements. Josh Becker spoke for the applicant on missing-middle housing, and staff covered sidewalk, curb and gutter plans. The developer plans to sell the homes, and the current owner will keep one. Ordinance 26-04: Fortner rezone, R-1-10 to RM(12), 0.65 acre

    Approved with conditions

Adopted on the condition of a development agreement and a plat limiting the site to six lots, with each unit sold on the open market; the ordinance takes effect when both are delivered to the city. Council members discussed unit count, owner occupancy and sale versus rental, with the city and council attorneys responding. Ron Larson, Shannon Maynard, Miriam Tucker and a written comment read by Dustin Fratto opposed the rezone, citing a neighboring home converted to a triplex, safety, rentals, density and precedent. Ben Child, for the developer, said each townhome would have its own lot and yard and agreed to the conditions. Adopted by roll call; tally not in the notes. The council recessed 9:14 to 9:18 p.m.
