Utah Legislature

Federalism Commission

5 senators and 9 representatives · 3 Democratic, 11 Republican

What the law says it does

Utah Code 63C-4a-302 creates the commission with 14 voting members: five senators, four from the majority party and one from the minority party, and nine representatives, seven from the majority party and two from the minority party. The Legislative Management Committee may add nonvoting members from a list the cochairs recommend. The commission may meet up to nine times a year unless the Legislative Management Committee approves more, and the code provides for it to close meetings under the Open and Public Meetings Act.

Under 63C-4a-303 the commission may evaluate a federal law, whether the commission, a council member or a monitor reports it, and may contract with a Utah public college or university to watch federal law for effects on federalism and state sovereignty. It gives each interim committee an annual report on federal actions that implicate those principles. If it finds a federal law unauthorized by the U.S. Constitution or in violation of federalism, the commission or a cochair may ask Utah's U.S. senators and representatives for information or help, send written notice to the federal agency, and request a response by a set date.
