  2. Item VI · Contract

Consent agenda: employee housing management and library artwork

    Approved · 5-0

The consent agenda approved a three-year contract with Sellers Management and Development (The Sellers Group) for property management of city employee housing, and acquisition of eight artworks for library study rooms.

Moved by Council Member Ryan Dickey, seconded by Council Member Bill Ciraco. Vote: 5-0

  3. Item VII.1 · City code

Resort support commercial and master planned development accessory uses (Ordinance 2024-21)

    Approved with conditions · 5-0

The council amended the Land Management Code to keep the 5% support commercial and 5% meeting space allowances without the previously recommended cap, limit residential and resort accessory uses to back-of-house, allow resort support commercial by conditional use permit instead of an MPD amendment, and revise hotel and condo-hotel definitions. The Planning Commission had unanimously recommended it and the pending ordinance expired January 8, 2025. The adopted version omits a staff-proposed ban on conventional chain businesses and deletes "generally" and "often" from definitions. The commission will review whether the 5% allowances are interchangeable. A hotel owner, Tony Tyler, supported the 5% without a cap but opposed the chain provision; Deb Rentfrow asked for commission review; a written comment called the proposal punitive to one landowner. A first motion by Council Member Rubell did not get a second.

  4. Item VII.2 · Roads and utilities

Spiro Mine Tunnel construction agreement amendment, phase 2

    Approved · 5-0 · Spiro Mine Tunnel

The council approved an amendment with Harrison Western Construction Corporation bringing the contract to $6,940,920. Staff described access and high water-flow complications and planned steel reconstruction in phase 3. The tunnel supplies about 30% of city water (slides say 33%) and addresses collapse risk.

Moved by Council Member Tana Toly, seconded by Council Member Bill Ciraco. Vote: 5-0

  5. Item VIII.1 · City code

    Revised procurement rules (Resolution 29-2024)

    Approved · 3-2

The council adopted revised procurement rules with the small purchase threshold for goods and for professional services set at $50,000, below the staff proposal of $75,000 for goods and $100,000 for professional services and IT. Council Members Rubell, Parigian and Ciraco said requests for proposals ensure fairness; Council Members Dickey and Toly were comfortable with higher staff thresholds. The motion did not address the $10,000 incidental charges limit.

Moved by Council Member Jeremy Rubell, seconded by Council Member Ryan Dickey. Vote: 3-2; Council Members Ryan Dickey and Tana Toly voted no. Voting no: Council Member Ryan Dickey, Council Member Tana Toly

  6. Item VIII.2 · City code

    Stormwater discharge code (Ordinance 2024-20)

    Approved · 5-0

The council amended Title 13-4 to follow state rules effective January 1, 2025: electronic inspection submissions, a 14-day review period, a notice-of-violation process limited to stormwater plan violations, and renaming the land disturbance permit a work permit. No one spoke.

Moved by Council Member Ryan Dickey, seconded by Council Member Bill Ciraco. Vote: 5-0

  7. Item VIII.3 · Parks

Temporary pickleball facility at the Utah Film Studio

    Discussed

Recreation staff proposed leasing an indoor bay with six courts at about $20,000 a month, flooring of about $60,000 and portable restrooms at $2,400 a month, targeting a February 1 opening. Revenue of about $216 an hour would recover costs at 50 to 70% use. Council Member Dickey was not in favor, citing no lease security; the other members supported continuing, and the minutes record no formal vote.

    • Purchase$60,000 Court flooring estimate
  8. Item HA · Development

Housing Authority: Founders Place mitigation plan amendment

    Approved · 5-0 · Deer Crest

Sitting as the Housing Authority, the council changed a condition of approval for the 78-unit Founders Place condominium project in Deer Crest so certificates of occupancy are issued building by building rather than by phase. The required housing obligation is 9.96 units with 12.97 anticipated through in-lieu payments. The second building was nearly complete. Deb Rentfrow withdrew her opposition after a tour.
