Homeless resource center and shelter zoning pause

Three-part text amendment. Part one removes homeless resource centers and shelters as conditional uses in the CG, D-2 and D-3 districts for a pause while new rules are written; the Council adopted Ordinances 15A and 15B on March 22, 2022 with a legislative intent on geographic equity. Parts two and three will cover permanent approval processes and temporary or seasonal shelters, including HB 440.

  1. March 22, 2022 · City Council

Homeless resource center and homeless shelter text amendments

    Approved · 6-0

After a hearing with about 20 speakers, the Council adopted Ordinances 15A and 15B of 2022 and a legislative intent asking the administration to include recommendations promoting geographic equity, including expanding the zoning districts where such facilities are allowed, in the later phases. The ordinances remove the uses as conditional uses in the CG, D-2 and D-3 districts; existing housing is not changed. Speakers in favor said the pause would allow time to share services across the city and address provider accountability. Speakers against, including a service provider, said it would not change where people are located, would move people away from services and that the proposal needed more review. Council members said the pause was meant to allow a proper plan, that homelessness requires an equitable distribution of services across the city, and that many discussions had already been held.

Homeless resource center and homeless shelter text amendments (follow-up)

    Discussed

Nick Tarbet presented two ordinance options: Ordinance 15A would pause the use by removing it from land use tables until a new regulatory scheme is adopted, and 15B would repeal the removal. Council members discussed legislative funding, a possible commission, the need for other jurisdictions to share the work, and a more thorough plan. Tarbet said Ordinance 15A would take effect April 1, 2022.

  3. March 8, 2022 · City Council work session

Homeless resource center and homeless shelter text amendments

    Discussed

Staff proposed, as the first of three phases, removing homeless resource centers and shelters as conditional uses in the CG, D-2 and D-3 zones for 180 days starting about April 2, 2022, without affecting existing facilities or approved temporary shelters. Without action, anyone could apply for a new facility under existing rules. Phase two would update regulations and the approval process, with a Planning Commission review in June 2022; phase three would address temporary and seasonal shelters, including a winter overflow plan required by HB 440 by Sept. 1, 2022. Council members discussed floating versus overlay zones, accountability if the pause lapses, expanding where services may locate for geographic equity, and keeping the discussion compassionate. A legislative intent and two ordinance options were discussed.
