Temporary signs on residential fences, Ordinance 23-03 (File CA01172023-0006470)

    Denied

Community Development Director James Sorenson presented the ordinance, which would allow temporary signs on residential fences on private property. Pat Jones supported it on First Amendment and property-rights grounds. The council said it had received 70 to 80 emails, mostly opposed, and discussed with legal staff whether current rules comply with the law; legal's view was that they do. Council Member Zach Robinson moved to table the item indefinitely with no reconsideration for at least 12 months; after a 7-0 vote to call the question, the motion to table failed 3-4 (Stroud, Robinson and Mecham yes; Houseman, Sharkey, D'Sousa and Earl no). Sharkey then moved, seconded by Council Member Brooke D'Sousa, not to adopt Ordinance 23-03, keeping the current ordinance in place; the minutes say it carried and that Stroud abstained and explained her reasons, with no tally recorded. The database action label reads adopted, which conflicts with the motion.

Moved by Council Member Cyndi Sharkey, seconded by Council Member Brooke D'Sousa
