Child Welfare Legislative Oversight Panel

2 senators and 3 representatives · 3 Republican, 2 Democratic

What the law says it does

Utah Code 36-33-102 creates the panel with five legislators: two senators, one from each party, and three representatives, two from the majority party and one from the minority party. Members serve two-year terms, and the Office of Legislative Research and General Counsel provides staff.

Under 36-33-103 the panel examines how the executive and judicial branches carry out the laws governing the child welfare system and takes testimony on request from the public, the juvenile court and state agencies. Before October 1 each year it receives a report from the Administrative Office of the Courts on cases that missed the time limits for shelter, adjudication, disposition, reunification and permanency hearings, with the reasons. It recommends budget proposals to the Social Services and Criminal Justice appropriations subcommittees before December 1, and reports its findings each year to the Senate president, the House speaker, and the Health and Human Services and Judiciary interim committees.

The statute also lets the panel review and discuss individual child welfare cases.
